Settlement Agreed in Foot Injury Sustained in Department Store

Associate Katrina Lagan recently negotiated settlement in a personal injury matter for Mrs N, who sustained a serious injury to her foot.

In April 2024, Mrs N was shopping in a local department store, when she stepped on an unmarked display frame jutting out into the aisle of the shop. This unbalanced her and caused a sharp pain in her right foot as she lurched forward. Following the incident, Mrs N had to walk in a great deal of pain t to locate a staff member to ask for help. She was eventually helped off the premises by her husband and the store manager.

The store’s failure to provide a safe shopping environment by adequately signposting the area, and subsequent failure to provide satisfactory first aid and care, formed the basis of this claim for negligence and breach of statutory duty.

As a result of the accident, Mrs N attended the local Minor Injuries Unit and was diagnosed with a broken fourth metatarsal on her right foot and given a boot to wear for eight weeks. Further treatment was required from a local Fracture Clinic. Mrs N went on to develop plantar fasciitis which continues to impact her daily life and driving ability.

Instructions were received for this claim in the weeks following the incident. Pre-action correspondence was quickly dispatched and medical records  obtained, which allowed for the commission of an expert report.  Liability was accepted pre-proceedings.

Following service of this medical evidence, the insurance company for the department store initiated settlement negotiations. Following discussion between the parties the matter resolved and Mrs N was delighted with the outcome.
